Cases involving delays in treatment of cancer can be difficult to pursue – particularly when the patient is living and has not experienced recurrence or metastasis. A dynamic duo of attorneys (who also happen to be mother and daughter) will discuss their approach to this case involving delayed removal of invasive breast cancer, how they were able to achieve a high verdict and what this means for medical negligence cases going forward.
Case Description
The plaintiff, Melissa Ward, was 40 years old when she underwent five months of chemotherapy followed by nipple-sparing mastectomy to remove invasive triple negative cancer from her right breast. Except the surgeon failed to remove a significant portion of breast tissue – including the cancer. A series of subsequent errors on the part of the surgeon, the medical oncologist, and two radiologists resulted in no one detecting the retained tumor for nearly nine months. By the time the tumor was removed the patient had developed DCIS in the surrounding breast tissue, requiring multiple additional surgeries, 5 weeks of daily radiation therapy, chest reconstruction surgeries bilaterally, and the deprivation of standard, evidence-based chemotherapy treatment.
